Nevada Cannabis Law History

Medical marijuana became legal in Nevada after a 59% approval of the Nevada Medical Marijuana Act by voters in 1998 and a 65% approval in 2000, allowing patients and caregivers registered with the state to grow up to 7 plants and possess up to an ounce of marijuana. In 2013, Senate Bill 374 was signed by Governor Brian Sandoval, providing for state-licensed marijuana establishments and allowing home-grow to continue until 2016.

After two failed attempts at adult-use legalization in 2002 and 2006, the Nevada Marijuana Legalization Initiative was passed on the 2016 ballot. Also known as Question 2, it made recreational consumption of cannabis legal on January 1, 2017. Originally, recreational sales from state-licensed dispensaries were to begin on January 1, 2018 per the text of the initiative. However, the Nevada Department of Taxation approved regulations for implementing Question 2 that allowed sales to begin six months earlier on July 1, 2017 for already-licensed retailers in good standing with the state.

Sales of recreational product began on July 1, 2017.

There is not currently an open application period in Nevada, but new licenses may become available as early as 2019 per the Nevada 2016 Marijuana Legalization Initiative.

Application Fees/Start-up Costs

Per the Nevada 2016 Marijuana Legalization Initiative, there is a one-time application fee of $5,000 for each type of medical marijuana establishment. A full table of maximum fees that the Department of Taxation is able to charge can be found in Sec. 12 of the text of Question 2.

The current renewal fees for marijuana establishments are as follows:

  • Dispensary $5,000
  • Cultivation $1,000
  • Production $1,000
  • Laboratory $3,000

License types

There are currently four types of marijuana establishments: Cultivation, Production, Dispensary, and Laboratory.
