The Massachusetts Marijuana Legalization Initiative, also known as Question 4, appeared on the November 8, 2016 ballot as an indirect initiated state statute and passed with a “yes” vote of 53.7%. Question 4 made it legal for adults over the age of 21 to possess up to one (1) ounce of marijuana outside of their homes, up to ten (10) ounces of marijuana in their homes, grow up to six (6) marijuana plants in their homes, and give another person who is at least 21 years old up to one (1) ounce of marijuana without payment. It also allowed people over 21 years old to possess, produce, or transfer hemp, as well as make or transfer items related to marijuana use, storage, cultivation, or processing. It also provided for the regulation and taxation of marijuana, marijuana accessories, and other marijuana products.
The original text of Question 4 allowed for recreational sales to begin in the state on January 1, 2018, but the state legislature voted to delay sales by six months on December 28, 2017, making the new date to begin sales July 1, 2018.
The final regulations for the recreational program were filed on March 15th, 2018.
The Cannabis Control Commission began accepting all types of licenses on April 1st, 2018.
Cannabis sales are scheduled to begin July 1st, 2018.
Application Fees/Start-up Costs
A list of application and annual fees for all types of licenses can be found in section 500.005 of the regulations.
Under the final regulations, there are fourteen (14) license types available:
Tier 1: up to 5,000 square feet of canopy
Tier 2: 5,001 to 10,000 square feet of canopy
Tier 3: 10,001 to 20,000 square feet of canopy
Tier 4: 20,001 to 30,000 square feet of canopy
Tier 5: 30,001 to 40,000 square feet of canopy
Tier 6: 40,001 to 50,000 square feet of canopy
Tier 7: 50,001 to 60,000 square feet of canopy
Tier 8: 60,001 to 70,000 square feet of canopy
Tier 9: 70,001 to 80,000 square feet of canopy
Tier 10: 80,001 to 90,000 square feet of canopy
Tier 11: 90,001 to 100,000 square feet of canopy
